TUTORCONNECT HOME TUITION MASTER SERVICE AGREEMENT

AND The registering individual ("Tutor", "You", "Independent Contractor")
1.1 By accessing tutor.iq9.in, completing the registration form, clicking the mandatory "I Agree" checkbox, or submitting via WhatsApp referral, you expressly acknowledge having read, understood, and voluntarily accepted ALL terms herein.
1.2 This constitutes a legally binding electronic contract under Section 10A, Information Technology Act, 2000. The Platform records IP addresses, timestamps, and device info as proof of acceptance (admissible per Section 65B).
1.3 Continued use of the Platform constitutes renewed acceptance of any updated terms.
2.1 Strict independent contractor relationship. No employment, partnership, agency, or joint venture is created.
2.2 The Platform acts SOLELY as a technology aggregator facilitating Client connections. The Platform exercises no direct supervision over teaching methods, schedules, or Client interactions.
2.3 The Tutor is solely responsible for their own taxes, insurance, and legal compliance.
3.1 Eligibility: 18+ years, minimum graduation, verifiable teaching credentials.
3.2 Free Registration: ZERO upfront fees. Complete online form OR WhatsApp preliminary.
3.3 Required Documents: Aadhaar (partial), educational certificates, experience proofs, professional photo.
3.4 Verification: Manual review (3–7 business days). Platform discretion is absolute for approval or rejection.
3.5 False Information: Immediate termination, permanent ban, and potential legal reporting (IPC Section 420).
4.1 Post-Placement Negotiation: Upon a suitable Client match, a WhatsApp discussion establishes a FIXED monthly remuneration via mutual agreement.
4.2 Client Billing Confidentiality: The differential margin and fees paid by the Client to the Platform are strictly confidential commercial arrangements. The Tutor has NO RIGHT to know, inquire, dispute, or claim any portion of the Client's payment to the Platform.
4.3 Payment Contingency (Pay-When-Paid): The Platform acts solely as a payment collection facilitator. ALL disbursements to the Tutor are strictly contingent upon the Platform actually receiving cleared funds from the respective Client. The Platform shall not pay from its own corpus in the event of Client default.
4.4 Proof of Service: The Tutor must complete the Platform-provided attendance register, obtain the Client/parent signature, and WhatsApp a photograph of it to the Platform.
4.5 Payment Timeline: Payments will be processed within SEVEN (7) business days after the Platform successfully realizes the funds from the Client and verifies the proof of service. No pre-7 day queries permitted.
4.6 Payment Method: UPI/Bank Transfer only. The Tutor bears all respective bank charges and taxes.

6.1 Conduct: Punctuality, prepared lessons, child safety, and progress tracking are mandatory.
6.2 Confidentiality: Absolute non-disclosure of Client details, addresses, and Platform operations.
6.3 Statutory Compliance: The Tutor must strictly adhere to the POCSO Act, child protection laws, and local education regulations.
7.1 No Guarantees: No guarantee of minimum placements, minimum earnings, Client payment reliability, or teaching outcomes.
7.2 Zero Liability for Misconduct: The Tutor assumes absolute legal liability for their conduct at the Client's premises. The Platform categorically disclaims liability for any civil damages, criminal acts, torts, or statutory violations committed by the Tutor.
7.3 Indemnification: The Tutor explicitly agrees to indemnify, defend, and hold harmless Fatima Enterprises (TutorConnect) against any FIRs, lawsuits, or financial claims initiated by Clients arising from the Tutor's actions.
7.4 Terms Amendments: The Platform reserves the unilateral right to update these terms at any time. Changes are effective immediately upon website publication.
8.1 Platform Rights: Immediate termination without notice for breach, complaints, or invalid documents.
8.2 Post-Termination: The 24-month non-circumvention clause survives termination. Data is retained for 2 years for legal compliance.
9.1 Amicable Resolution: 7 days mandatory negotiation.
9.2 Jurisdiction: EXCLUSIVE jurisdiction of the competent courts in Ranchi, Jharkhand.
9.3 Governing Laws: Indian Contract Act 1872, IT Act 2000.
